Writ Petition No. 596 of 2004
ORDER:
The petitioner states that she was engaged as a daily wage worker in the Government Ashram High School, Parakalagand, Khammam District, from 1994 onwards, and though she made repeated representations for regularization of her services, no action has been taken by the respondents 2 and 3.
Heard the learned counsel for the petitioner and learned counsel for the respondents.
The appointment of the petitioner was on daily wage basis. Even the service certificate, that is issued to her, discloses that she was entrusted the work on working days and not during holidays, or vacations. The question of regularizing the services of a temporary or casual employee would arise, if only he or she is working against a specific post. The petitioner is not able to state the post, against which, she is said to have worked. Further, much would depend upon the availability of vacancies, and the inclination on the part of the employer, to make appointment. In case the respondents propose to fill the vacancies, to which the petitioner is otherwise qualified, she can make an application, in response to a notification. The feasibility of granting relaxation as to age can also be considered, as and when the necessity arises.
Hence, the writ petition is disposed of, directing that, in case the respondents take any steps to fill the vacancies, in which the petitioner is qualified, her case may be considered, if necessary, by giving relaxation, as to age limit, for the period during which, she is said to have worked in the institution.
There shall be no order as to costs.
