“It is, therefore, prayed that this Hon’ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the proceedings dated 09.12.2009 and consequential proceedings dated 23.03.2010 threatening coercive action by declaring the impugned action is illegal, arbitrary and violative of rights guaranteed under Articles 14, 19(1) (g), 21 and 300A of the Constitution of Inida and consequently set aside the same.”

After arguing the case for sometime, Smt Ch.Lakshmi Kumari, learned counsel for the petitioner, seeks withdrawal of the writ petition with liberty to file a fresh writ petition along with proper pleadings and evidence in support of the stand of the petitioner that his father Venkata Reddy has discharged his share of obligation.

In view of the same, the writ petition is dismissed as withdrawn with liberty in terms of the prayer made.

As a sequel to dismissal of main petition as withdrawn, WPMP No.6954 of 2010 filed by the petitioner for interim relief is disposed of as infructuous.
