Heard Sri B. Devanand, learned Standing Counsel for the respondents.

The writ petitioner raised a dispute consisting settlement of gratuity, provident fund and other terminal benefits, which are payable to him due to the death of Sri V. Goverdhan Reddy, who was employed with Bharat Sanchar Nigam Limited.

The Central Government, by a notification dated 31.10.2008 issued under sub-section (2) of Section 14 of the Administrative Tribunals Act, 1985, conferred jurisdiction from the said date on the Central Administrative Tribunal, in terms of sub-section (3) of Section 14 of the said Act to decide all service disputes. Therefore, the writ petitioner will have to approach the Central Administrative Tribunal at the first instance and he cannot agitate the dispute for the first time in this Court, in view of the judgment of the Supreme Court in L. Chandrakumar v. Union of India^[1] .

Hence, this Writ Petition is dismissed only on the ground that the writ petitioner will have to approach the Central Administrative Tribunal at the first instance and if he is still aggrieved, then alone, he can approach this Court but not otherwise.

Registry is directed to return the original papers, if any filed by the writ petitioner so as to enable him to file the same before the Central Administrative Tribunal, Hyderabad Bench or any other forum.
