ORDER:
This writ petition is filed for the following substantive relief:
“…to issue Direction, or a Writ more particularly one in the nature of writ of Mandamus declaring the acts of the respondents in demolishing the existing structure over the property bearing D.No.10/13/A, admeasuring 6.07 cents, circar Khushki upto Ac.0.20 cents equivalent to 968 sq.yds., or 813.12 sq.metres, in Sy.No.161/2, situated at Kandulapuram Village, Cumbum Mandal, Prakasam District, as illegal arbitrary, and violative of Art.14, 19 and 21 of Constitution of India and all canons of fair play and natural justice and consequently issue directions to the respondents not to demolish the existing structure over the said property.”
At the hearing, Sri K.Gani Reddy, learned counsel for the petitioners, seeks permission of the Court to withdraw the writ petition with liberty to his clients to file a fresh writ petition with proper pleadings. The writ petition is accordingly dismissed as withdrawn with liberty in terms of the prayer made.
As a sequel to dismissal of the writ petition, W.P.M.P.No.41395 of 2010 filed by the petitioners for interim relief is disposed of as infructuous. (C.V.NAGARJUNA REDDY, J)
