This Writ Petition is filed for a mandamus to direct respondent No.1 to consider the petitioners’ representation dated 3010-2010 and to conduct enquiry into the misappropriation of Gram Panchayath funds.

The petitioners are Ward Members of respondent No.3-Gram Panchayath. They felt aggrieved by the inaction of respondent No.1 in considering their above mentioned representation wherein they have alleged that the Sarpanch in collusion with the Village Secretary of respondent No.3-Gram Panchayath has misappropriated the Gram Panchayath funds.

In my opinion, the cause sought to be espoused by the petitioners in this Writ Petition involves an element of public interest. Therefore, respondent No.1 is under an obligation to consider the petitioners’ representation and take appropriate action depending upon the truth or otherwise of the allegations in accordance with the provisions of the A.P. Panchayat Raj Act, 1994.

For the above mentioned reasons, the Writ Petition is disposed of with the direction to respondent No.1 to consider and dispose of the petitioners’ representation dated 30-10-2010 and take appropriate action in accordance with law within a period of one month from the date of receipt of a copy of this order.

As a sequel to disposal of the Writ Petition, WPMP No.40419/2010 is disposed of as infructuous.
