This writ petition is filed seeking to declare the action of the respondents in not handing over the original house site pattas to 55 beneficiaries of the petitioner’s society as illegal and arbitrary and consequently, to direct the respondents to handover original house site pattas to the beneficiaries of the petitioner-society as per the list prepared by them in respect of the approved land situated in Sy.No.57 to an extent of Ac.2.10 gts., of Shamshiguda village, Balanagar

It appears that the petitioner is a Weaker Section Housing Society, a registered body, represented by its General Secretary V. Vijaya Rao, S/o late Muttaiah. According to the petitioner-society, its members are landless poor persons and applied for grant of small extents of land for locating their houses in Sy.No.57 in an extent of Ac.2.10 gts., of Shamshiguda village, Balanagar Mandal, Rangareddy District. Earlier when their representations were not considered, they filed W.P.No.4070 of 1997 and the said writ petition was disposed of on 6.12.1999 with the following direction:

“Under the above circumstances, the respondents are directed to distribute the pattas, which were already prepared and also hand over the physical possession of the house sites, which was already proposed for allotment as per the certificates prepared. The said distribution of certificates and possession of the house sites is to be completed within a period of two months from the date of receipt of a copy of this order.”

It appears, in this regard on 22.8.2002, the Collector, Ranga Reddy District addressed letter dated 22.8.2002 to the Commissioner, Kukatpally Municipality, Ranga Reddy District, asking him to approve lay out in Sy.No.57 of Shamshiguda village as per G.O.Ms.No.4, M.A., dated 4.1.1999 and return for taking further action. The Commissioner in turn addressed letter, dated 9.10.2002 to the Deputy Collector & M.R.O., Balanagar, Rangareddy District, requesting him to depute the Mandal Surveyor for demarcation of Sy.No.57 of Shamshiguda village in the presence of Sri Raghunandan Raju, T.P.S. On that, the Deputy Collector & M.R.O., Balanagar Mandal, issued a memo, dated 28.10.2002 to the Mandal Surveyor, Balanagar, asking him to contact

the Commissioner, Kukatpally Municipality and demarcate the said land duly fixing the boundaries immediately and report the compliance.

According to the petitioner, in spite of these efforts, the order in WP No.4070 of 1997 has not been complied with and neither the beneficiaries of the petitioner-society are put in possession nor the lands were made into plots by demarcating properly nor pattas were issued.

Under those circumstances, the respondents are directed to complete the process of identification and demarcation of plots in Sy.No.57 of Shamshiguda village, Balanagar Mandal and to issue pattas to the beneficiaries of the petitioner-society and put them in physical possession of their respective plots, within a period of three months from the date of receipt of a copy of this order. If the process is not completed within the time stipulated above, it will be viewed seriously by this Court and contempt proceedings will be initiated.

The writ petition is accordingly disposed of. No order as to costs.
