ORDER:
When the matter was listed on 03.06.2010, none appeared for the petitioner nor was there any representation on his behalf. Therefore, the matter was posted to 04.06.2010 under the caption ‘for dismissal’. Accordingly, the matter is listed today under the caption ‘for dismissal’, none appears for the petitioner nor there is any representation on his behalf.
2. Since notice was not served on the contesting respondent No.4, this Court by order, dated 21.04.2009, granted two weeks time finally for taking effective steps for service of notice on condition of depositing Rs.250/- to the credit of the Secretary, State Legal Services Authority, Hyderabad, within one week and in default of such deposit, the writ petition would stand
dismissed for non-prosecution.
3. As per the office note dated 06.05.2010, put up by the Registry, the said conditional order has not been complied with.
4. Therefore, in view of the non-compliance of the conditional order dated 21.04.2009 and also as none appeared for the petitioner though the matter was listed under the caption ‘for dismissal’, the writ petition is liable to be dismissed.
5. Accordingly, the writ petition is dismissed. There shall be no order as to costs.
