ORDER:

The husband of the petitioner was employed as Driver in Musheerabad Depot of APSRTC. He died on 28.11.2003 due to cancer. There was some dispute as regards the payment of gratuity, claimed by the petitioner. Ultimately, the petitioner approached the Controlling Authority under Payment of Gratuity Act, 1972 and Assistant Commissioner of Labour-IV, Hyderabad and an order dated 09.03.2005 passed by the Authority was implemented.

The petitioner made a request to the respondents to provide appointment on compassionate grounds to her son. The claim was rejected on the ground that he was not qualified. Placing reliance on Circular dated 12.04.1997, the petitioner submitted a representation dated 27.09.2007 for extension of the additional monetary benefit in lieu of appointment on compassionate grounds. Her grievance is that no steps have been taken thereon. Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.

The question as to whether the petitioner is entitled to be extended the additional monetary benefit, even after the case on appointment on compassionate ground was rejected, needs to be examined by the respondents.

The petitioner made a representation in that regard way back on 27.09.2007. Such a representation cannot be pending for years together. Hence, the writ petition is disposed of directing the second respondent to pass appropriate orders on the representation dated 27.09.2007 made by the petitioner within a period of two

months from the date of receipt of a copy of this order. There shall be no order as to costs.
