Heard Sri M.V.Suresh, learned counsel for the appellantpetitioner and the learned Assistant Solicitor General for the respondents. At their request, the Writ Appeal itself is taken up for disposal at the stage of admission along with WP.No.21144 of 2009.

The facts of the case are that the appellant-petitioner, who is working as a Constable, complains against the non-extension of the deputation period after the expiry of the initial period, which has been granted. His grievance is that having regard to the reason that his mother is not well, he seeks extension of his deputation. Initially, the learned Single Judge granted interim stay and after vacate stay petition is filed the said stay was vacated. It is against this order; the present appeal has been filed.

During the course of arguments, learned counsel for the appellant-petitioner mentioned in regard to the representation filed by the appellant-petitioner as long back as on 04.09.2009 and submitted that no orders are passed on the said representation and hence, seeks indulgence of this Court.

Learned Assistant Solicitor General submitted that the authorities have already passed orders on the said representation on 09.10.2009 granting two months time.

Having regard to the facts and circumstances of the case,

especially the representation of the appellant-petitioner already being considered and orders already passed granting two months time, nothing survives in this appeal or in the Writ Petition. In view of the same, nothing remains to be adjudicated in both the Writ Appeal and the Writ Petition, as no further question arises.

Accordingly, the Writ Appeal and the Writ Petition are disposed of. However, we make it clear that in the event of the appellantpetitioner still insisting any exigency for further extension, he can file a representation before the authorities concerned within a period of two {2} weeks from today and the same shall be considered on merits and disposed of in accordance with law within a period of six {6} weeks thereafter. It is needless to mention that till the representation filed by the appellant-petitioner is considered and disposed of, he shall not be disturbed. No costs.
