WRIT APPEAL NO.825 OF 2010
JUDGMENT:
Heard both the sides.
Admittedly, this appeal is filed against the ad interim order dated 08.04.2010 in W.P.M.P.No.9936 of 2010 in W.P.No.7724 of 2010. Though the learned counsel for the appellant submits that in spite of the fact that he filed counter along with the vacate stay application, the same is not being disposed of and hence, he approached this Court.
However, the fact remains that the vacate stay application is pending consideration. Hence, it is felt desirable that the application seeking to vacate the stay shall be disposed of before any appeal has to be taken up for consideration. In the circumstances, we do not find any reasons to entertain the appeal.
Accordingly, the Writ Appeal is dismissed leaving it open to the appellant to avail any remedy available to him under law in the event of final disposal of the vacate stay application. No costs.
