1. This writ appeal is directed against the order, dated 28.2.2002 passed by a learned single Judge of this Court dismissing W.P.No. 25393 of 1995 filed by the appellant herein seeking implementation of G.O. Rt. No. 354, Education (CE-II-I) Department, dated 21.3.1995. During the
pendency of the writ petition itself, the aforesaid G.O. has been superceded by G.O.Ms.No. 78, Education (CE.II-I) Department, dated 15.3.1996 with certain modifications. In view of the same, the very basis of the writ petition stands altered and the writ petition has become infructuous. Hence the relief sought for in the writ petition as well as in the present writ appeal cannot be granted. 2. Accordingly the writ appeal is dismissed, granting liberty to the petitioner/appellant to challenge G.O.Ms.No. 78, Education (CE.II-I) Department, dated 15.3.1996, if so advised. No costs.
