JUDGMENT: (Per the Hon’ble Sri Justice B.Prakash Rao) Heard both the sides. At their request, the appeal itself is taken up for disposal.

The appellant-Financial Corporation files this appeal seeking correctness of the order dated 09.07.2009 in dismissing the application in C.A.No.1511 of 2008 by the learned Single judge, whereunder they sought to modify the order dated 12.02.2008 passed in C.A.No.23 of 2008, insofar as the direction of depositing 75% of the sale consideration amount of Rs.6,54,000/-, as ordered by this Court in Company Application No.1333 of 2007. The said application was dismissed, after taking into consideration, especially, the earlier chequered events, which led to the virtual rejection of the very same relief in the earlier orders.

Admittedly, the appellant approached this Court many times, apart from approaching by way of appeal to the Division Bench and all such requests have been negatived, on the face of which several orders are starring at him and as rightly observed by the learned Single Judge, the present application is not maintainable nor any relief

can be sought for. In the circumstances, we are in the entire agreement of the decision of the learned Single Judge, especially when all such earlier orders occasion have become final, conclusive and binding on one or more occasions.

Hence, there are no merits in the appeal and is, accordingly, dismissed. No costs.
