This Civil Revision Petition, under Article 227 of the Constitution of India, is directed against the order, dated 25.01.2010, in C.M.A. No.5 of 2010, on the file of the learned Agent to Government, Khammam District, whereunder and whereby, the order, dated 16.12.2009, in I.A. No.216 of 2009, on the file of Sub-Divisional Magistrate (Mobile Court), Bhadrachalam, was set aside.

The grievance of the petitioner is that without hearing the petitioner, the Agent to Government, Khammam, has passed an order setting aside the injunction granted by the Sub-Divisional Magistrate (Mobile Court), Bhadrachalam. As seen from the record, no opportunity was given to the petitioner to advance his arguments

before passing the order under challenge. Hence, the impugned order is set aside, directing the Agent to Government, Khammam, to dispose of the same within a period of four weeks from the date of receipt of a copy of this order, after calling for the records from the Sub-Divisional Magistrate (Mobile Court), Bhadrachalam and after giving reasonable opportunity to both the parties.

4. Accordingly, the Civil Revision Petition is allowed. No costs.
