CIVIL REVISION PETITION No. 3603 of 2009
ORDER:
This Civil Revision Petition is filed by the petitioner aggrieved by the order of the I Additional District Judge, Srikakulam in I.A.No.69 of 2009 in A.S.No.44 of 2009 dated 19.06.2009.
I.A.No.69 of 2009 was filed seeking stay of execution of the proceedings, in E.P.No.9 of 2009 in O.S.No.90 of 2005, on the file of the Principal Senior Civil Judge, Srikakulam, towards execution of the decree passed in O.S.No.90 of 2005 dated 31.12.2008. The Appellate Court granted stay on condition of the respondent depositing the suit costs and either on deposit of the suit amount or furnishing security towards the said amount.
Sri K.Venkata Rao, Learned Counsel for the respondent, submits that this order has been complied with by the respondent.
Since the entire suit amount has either been deposited, or security furnished therefor, I see no reason to vacate the order passed as more than 1 year 3 months has elapsed since then. Ends of justice would be met if the Court below is directed to dispose of the first appeal as expeditiously as possible.
Subject to the above observations, the Civil Revision Petition is dismissed.
