ORAL ORDER:
Heard learned counsel appearing for the petitioner-3rd party. 2. This Civil Revision Petition is directed against the order and decree, dated 3.8.2009, in I.A.No.1152 of 2009 in O.S.No.28 of 2008, passed by the V Additional District Judge, Vijayawada, Krishna District, dismissing the application filed under Order 1 Rule 10 and Section 151 of C.P.C., seeking to implead the petitioner-3rd party as 2nd defendant in the suit.
3. When the matter came up for hearing, learned counsel for the petitioner-3rd party submits that as against the impugned order, as an abundant caution, simultaneously an appeal also has been preferred
with the leave of the Court and in view of the same, the present civil revision petition is not maintainable.
4. In view of the said submission made by the learned counsel for the petitioner-3rd party, the civil revision petition is dismissed as not maintainable, at the stage of admission. No order as to costs.
