CIVIL REVISION PETITION No. 284 of 2009

ORDER:

1. This Civil Revision Petition is directed against the order dated 21.11.2008 in I.A. No.325 of 2008 in O.S. No.46 of 2007 on the file of the Junior Civil Judge, Kothavalasa, Vizianagaram district.

2. The petitioner, who is plaintiff in the suit, filed the petition to summon the Tahsildar, Kothavalasa for production of original document of Ex.X1. That petition was dismissed on the ground that it was lacking the name and other particulars of the Tahsildar, who issued the document.

3. The learned counsel for the petitioner contended that since Ex.X1 is a public document, the Tahsildar can be summoned. But, the present Tahsildar is not the person who issued Ex.X1. The Officer, who issued Ex.X1, is the competent person to speak about the contents therein. Name and other particulars of the officer, who issued Ex.X1 are not mentioned in the petition. Therefore, the trial Court rightly dismissed the application, and there are no grounds to interfere with the same.

4. The Civil Revision Petition is, accordingly, dismissed. No costs. However, it is left open to the petitioner to file a separate application for summoning the Officer, who issued Ex.X1, furnishing his name and other particulars, and the same shall be considered in accordance with law.
