Judgment:
This revision case is filed aggrieved by the order dated:29.12.2009 passed in Crl.M.P.No. 7011 of 2009 in C.C.No.290 of 2003 by the learned Judicial Magistrate of First Class for Prohibition and Excise, Guntur, refusing to recall the NBW issued against the petitioner.
2. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
3. There absolutely no merits in the revision case and it is accordingly dismissed. However, the petitioner shall personally appear before the court below and file a petition, within one month from today, for recalling of NBW, which shall be decided by the learned Magistrate on merits.
