ORAL ORDER
The petitioners, in spite of obtaining stay of all further proceedings in CC No.289/2006 on the file of Judicial First Class Magistrate, Mahaboobabad on 25-6-2008, have not evinced any interest to serve the notice on the first respondent-defacto complainant. Further, the docket proceedings would show that none appeared when the case was called on 10-12-2007, 27-12-2007 and 25-2-2008. When the matter was taken up for hearing on 12-8-2010 after granting stay, none appeared on behalf of the petitioners and therefore the matter was directed to be posted for dismissal. On 19-8-2010, this court permitted the learned counsel for the petitioners to take out notice to the first respondent intimating that the matter will be heard and decided on 31-9-2010. In spite of specific direction, to-day ie., 3-9-2010, when the case is called, none appears on behalf of the petitioners nor any representation is made on their behalf. In view of the same, it is presumed that the petitioners are not interested to prosecute their case.
In view of the same, the Criminal Petition is dismissed. However, the trial court shall take note of the judgment of the Supreme Court in Y.ABRAHAM AJITH V. INSPECTOR OF POLICE (2004(8) SCC 100) while deciding CC No.289/2006 pending on its file.
