ORDER:
This petition under Section 482 of Code of Criminal Procedure has been filed to quash the proceedings in Crime No.99 of 2007 on the file of Devarapalli Police Station registered for the offence under Section 420 I.P.C.
Initially, this Court, by order, dated 14.11.2007 stayed the execution of N.B.Ws. and it was extended from time to time and lastly
the stay was extended on 5.3.2008 for a period of two weeks and thereafter, it has not been extended.
Further the complaint allegation clearly discloses that the petitioner, who has no right in respect of the land to an extent of Ac.0.07 cents in Sy.No.1141/2A of Deverapally Village which was acquired under Land Acquisition Act for Indira Sagar Project right main canal, received the compensation of Rs.2,05,800/- without any lawful right by cheating the Government. Prima facie, the complaint allegation discloses an offence to be investigated by the police. Therefore, I see no ground to quash the impugned proceedings.
Accordingly, the Criminal Petition is dismissed.
