This petition has been filed to quash the order, dated 6.5.2010, in Crl.M.P.No.1308 of 2010 in Cr.No.30 of 2010 passed by the XVI Metropolitan Magistrate, Cyberabad, Kukatpally at Miyapur, and thereby seeking a direction to release the passport of the petitioner.

The petitioner has been voluntarily surrendered on 6.4.2010 and he was enlarged on bail on condition that he shall surrender his passport. Accordingly, the passport was deposited in the court. The allegation against the petitioner is that he was in connivance with the other accused collected Rs.1,44,000/- from eight students promising to get them passed in the failed subjects of Dr.B.R.Ambedkar University.

Learned counsel for the petitioner submitted that the petitioner has been pursuing his studies in M.B.A in EThames Graduate School, University of Gloucestershire, England. It is further submitted that the petitioner has to report before his Graduate School on or before 3.5.2010 and therefore he sought for return of his passport. In support of his case, he has filed identity card issued by the E Thames Graduate School and the G-mail message sent from the said school stating that he has to report by 24.5.2010 and to attend DMS second term classes and submit new assignments in July, 2010 and be on the September intake for Sunderland.

In the circumstances, I am inclined to order as follows: On condition of the petitioner executing personal bond for a sum of Rs.1,00,000/- with one surety for the like sum and on further condition of depositing of title deed of any immovable property worth more than Rs.1,00,000/-, the

passport of the petitioner shall be returned to him for a period of six months. Soon after his return from England, the petitioner shall return the passport on or before 20.10.2010. The criminal petition is accordingly disposed of.
