Petition under Section 482 of Crl.P.C praying that in the circumstances stated therewith, the High Court may be pleased to quash the F.I.R.No.125 of 2002 on the file of the 3rd respondent and the consequent charge sheet No.103 of 2002 in C.C.No.262 of 2002 on the file of the Hon'ble Court of 1st Class Judicial Magistrate, Husnabad as against the petitioner/accused No.2 in the interests of justice.
The petition coming on for hearing, upon perusing the petition and memorandum of grounds filed herein, and orders of High Court dated 20-3-2007, 24-4-2007, 27-4-2009 made herein and upon hearing the arguments of Sri A.P. Venugopal, Advocate for the petitioner and the Public Prosecutor for the Respondents No.1 and 3, the Court made the following
ORDER:
“Notice of the second respondent is returned unserved as stated to be absent.
Learned counsel for the petitioner is permitted to take fresh personal notice to the second respondent by registered post with acknowledgment due and provide proof of service of the same by the next date of hearing.
Post on 28-7-2009.
Interim stay already granted shall stand extended till then.”
