Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue writ or direction preferably writ of mandamus, declaring the inaction of the respondents in considering the claims of the petitioners for the posts of A.N.M. (WOMAN) in Pasara Village, Rampur and Laknavaram Sub-Centres of Warangal District as per the notification 2/2008 dated 28-8-2008 by 1st respondent as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents to consider the claims of the petitioners for the said posts and pass

ORDER:

1. The petitioners applied for the post of A.N.M.(woman) on contract basis to work in Sub-Centres of Primary Health Centers as per G.O.Rt. No. 971, Health, F.W., (D1) Department, dated 25-7-2008 under a scheme of out sourcing agency issued by the District Medical and Health Officer, Warangal on behalf of ‘Rogi Kalyana Samithi’.

2. The Medical Officer-2^nd respondent interviewed the petitioners. According to the petitioners they are the only applicants for the sub-center of Rampur and Laknavaram of Pasara P.H.C. and there are no other applicants and therefore, they are to be considered for the post they applied. There being no communication to them with regard to the out come of Interview, they submitted representation to the District Collector and there being no response from the District Collector, they approached this Court invoking jurisdiction under Article 226 of the Constitution of India.

3. When the writ petition came up for consideration, learned Government Pleader for Medical and Health takes notices on behalf of the respondents 1 and 2.

4. The fact of that the petitioners appeared for the interview for the post of A.N.M.(woman) in the Sub-Centres of Rampur and Laknavaram P.H.C’s is not contradicted by the learned Government Pleader.

5. In that view of the matter, the writ petition is disposed of directing the petitioners to make a representation to the 1^st respondent-District Medical and Health Officer, Warangal to know the out come of their candidature for the post of A.N.M. ( woman) to work in Sub-Centres of Pasara P.H.C’s. No order as to costs.
