ORDER:
Learned counsel for the petitioners submits that they have
already filed suit being O.S.No.93 of 2006 on the file of the Senior Civil
Judge, Narsapur, claiming damages for unauthorized demolition of the
petitioners’ premises by the respondents. In view of the same, cause of
action in the Writ Petition does not survive and hence, he seeks
permission of this Court to withdraw the Writ Petition.
Permission as sought for is accorded and the Writ Petition is
dismissed as withdrawn. No costs.
