The petitioner sought a declaration that the inaction of the respondents in releasing the family pension due to her from November, 1996 was illegal.
By interim order dated 28.01.2004 the respondents were directed to release the family pension due to the petitioner as per law and continue to pay the same until further orders.
It is stated that pursuant to the said interim order the petitioner is being paid family pension in accordance with rules. No counteraffidavit has been filed by the respondents disputing the eligibility of the petitioner to the family pension claimed by her and presently being paid to her.
In the light of the aforestated developments, this writ petition is disposed of directing the respondents to continue to pay to the petitioner the family pension due to her in accordance with rules. In the circumstances of the case, there shall be no order as to costs.
