This Criminal Revision Case is directed against the judgment dated 03.08.2009 passed in Crl. Appeal No.360 of 2008 on the file of I Additional District and Sessions Judge, Guntur, whereby and whereunder the learned Additional District and Sessions Judge confirmed the conviction and sentence of the petitioner/accused for the offence under Section 138 of the Negotiable Instruments Act passed against him in C.C.No.159 of 2007 on the file of I Additional Judicial Magistrate of First class, Tenali.

2. When the revision came up for admission, the petitioner and the 2^nd respondent appeared before the Court along with their respective counsel and moved Crl.R.C.M.P.No.2397 of 2009 seeking permission to compound the offence. The said Crl.R.C.M.P. is being allowed by a separate order.

3. In view of the offence being compounded between the petitioner and the 2^nd respondent, the conviction of the petitioner for the offence

under Section 138 of the Negotiable Instruments Act is liable to be set aside.

4. Accordingly, the Criminal Revision Case is allowed at the admission stage setting aside the conviction and sentence of the revision petitioner for the offence under Section 138 of the Negotiable Instruments Act and he is acquitted of the same. The fine amount, if any paid by the revision petitioner, is ordered to be refunded to him.
