This appeal under Section 54 of the Land Acquisition Act, 1894 (for short ‘the Act’) by the Land Acquisition Officer is directed against the order of the Senior Civil Judge, Gadwal, dated 27.06.2000, passed in O.P. No.538 of 1994, whereby the reference Court fixed the market value of the acquired land at Rs.5,000/- per acre as against Rs.2,800/per acre awarded by the Land Acquisition Officer.
The claimant, dissatisfied with the fixation of the market value, had already carried the matter in appeal against the very same order being A.S. No.2577 of 2000 and this Court, by order dated 30.12.2005, allowed the said appeal preferred by the claimant fixing the market value of the acquired land at Rs.13,500/- per acre with all statutory benefits.
In view of allowing the appeal preferred by the claimant, the present appeal deserves to be dismissed and the same is, accordingly, dismissed. No costs.
