Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue a writ or order one inthe nature of writ of mandamus , declaring the action of the 1st respondent in granting the permission bearing No. 51/99 dt 17-12-99 to the contrary to Section 120 of A.P Panchayat Raj Act , 1994 , contrary to Section 89 and 92 of A.P Public Health Act , 1939 and contrary to Section 21 of the Air Pollution Control Act 1981 as illegal, unsustainable and violative of Art. 14 and 21 of the Constitution of India and consequently direct the 1st respondent not to permit the 2nd respondent to construct theRice Mill within the residential area of S.Rayavaram Village , Vishakapatnam District.
