Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to to issue writ order or direction more particularly one in the nature of writ of Mandamus declaring the inaction of the respondent in not transfering the premises bearing D.No.6-6-52 and 6- 6-53 situated at Herur Ward Tandur Ranga Reddy District despite submitting the application dt.11-4-2008 along with the all revelant documents as illegal arbitrary improper and consequently direct the respondent herein to effect the transfer of the above said property on the name of the petitioner herein by collecting the requisite charges and to grant such other relief or relifs

This writ petition has been filed by Medishetty Balakrishna, a minor represented by his natural guardian and mother- Smt Jayasri, with a prayer to issue a writ, Order or Direction, more particularly, one in the nature of writ of mandamus declaring the action of the respondent in not effecting the name of the petitioner in respect of the premises bearing D.Nos.6-6-52 and 6-6-53 situated at Herur Ward, Tandur, Ranga Reddy District, despite submitting the application dated 11.4.2008 along with all relevant documents, as arbitrary and illegal.

The petitioner claims to be a beneficiary under the Will dated 6.8.2003 executed by his grandmother namely Ramulamma. His grandmother died on 30.9.2006. Under the Will, his grand mother bequeathed the house property bearing D.Nos. 6-6-52 and 6-6-53 in his favour. The petitioner submitted an application before the respondent authorities for mutation of his name in the municipal records basing on the Will dated 6.8.2003, but his application remained unattended. Hence, this writ petition. When the writ petition has come up for admission, Sri Radhakrishna Polisetty, learned standing counsel took notice on

behalf of the respondent.

Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondent. Learned counsel appearing for the petitioner submits that the petitioner filed an application before Tandur Municipal Council for mutation of his name in the municipal records as owner of house bearing No.6-6-52 and 6-6-53, but his application remained unattended.

Learned Standing Counsel appearing for the respondent submits that the respondent-Municipal Council will consider the said application in accordance with the Alteration of Ownership of Property in Assessment Book Rules, 1966.

In that view of the matter, the writ petition is disposed of with a direction to the respondentto consider the application submitted by the petitioner in accordance with the Alteration of Ownership of Property in Assessment Book Rules, 1966 and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. No costs.
