Petition under Article 226 of the Constitution of India praying that in the circumstances stated s in the affidavit filed herein the High Court will be pleased to issue an order, direction, or a Writ, one in the nature of Writ of Mandamus (1) declaring the proceedings No.YCP/31E/547 dated 11-4-2000 issued by Respondent No.2 as illegal, arbitrary and unjust and jviolatiave of Article 14, 16, 21; (2) consequently set aside the proceedings dated 11-4-2000; (3) declare the action of the respondents in not trating the petitioner case on part with Sri Neelam Sammaiah and others by giving appointment as E.P. Operator as a fresh candidate as illegal, arbitrary, unjust and pass such other orders deemed fit and proper in the circumstances of the case.

Heard Sri G.Vidya Sagar, learned counsel for the petitioner and Sri K.Sreenivasa Murthy, learned counsel appearing on behalf of the respondents, and at their request the main writ petition itself is taken up for disposal.

In this writ petition the petitioner seeks to assail the impugned proceedings No.YLD/31E/547 dated 11-4-2000 issued by the 2^nd respondent dismissing the petitioner from service mainly on the ground that the driving licence produced by the petitioner is not a valid one.

After hearing the learned counsel on either side, and also on perusing the material, and especially, the orders passed by this Court in similar circumstances in W.P.No.12289/1999, dated 29^th March, 2005 wherein this Court disposed of the writ petition directing the respondents to consider the case of the petitioner therein for fresh appointment in a vacancy which arises subject to production of valid driving licence by the petitioner and after verifying the same as a genuine one.

The writ petition is accordingly disposed of directing the respondents to consider the case of the petitioner for fresh appointment in a vacancy, which arises subject to the petitioner produces a valid licence and after verifying the same as a genuine one. No costs.
