O R D E R:
The petitioner had assailed the appointment of
3rd respondent as Public Prosecutor, in the Court of District and Sessions Judge, Rajahmundry, through orders in G.O.Rt.No.1748, Law (L.A&J Courts.A2) Department, dated 22.9.2003. The attack was mainly on the ground that the rules of reservation have not been observed, while appointing the 3rd respondent.
This court is of the view that the necessity to examine the grounds urged by the petitioner, does not subsist, in view of the period, for which the 3rd respondent was appointed, had elapsed. Further, the impugned order was stayed by this court on 26.9.2003. In that view of the matter, the writ petition is closed as infructuous. There shall be no order as to costs.
