ORAL ORDER:
The petitioner wants to withdraw the writ petition to pursue appropriate remedies including by way of an appeal to the Debts Recovery Tribunal, under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short ‘the Act’), against the proceedings initiated by the 1st respondent-Bank, for sale by public auction of the immovable properties mortgaged by the petitioner to the said respondent for obtaining a loan and in respect of which loan amount, the petitioner defaulted. The sale is stated to be proposed in exercise of the powers of the Bank under Section 13 (4) of the Act.
In view of the submission, the writ petition is dismissed as withdrawn with liberty granted as sought. No order as to costs.
