Mr. TC Krishnan, learned counsel for the 4th respondent submits that the cause in the writ petition does not survive for adjudication and the writ petition has become infructuous.
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondent no.2 in not enquiring the case pertaining to the petitioner’s caste in the strict sense of judgment reported in AIR 1996 1011 as illegal and arbitrary and against national integration and the petitioner further consequently seeks a direction to the 2nd respondent to a make an enquiry into the case of the petitioner’s caste as per the discussion of law and not to vitiate the election of the petitioner to the post of Sarpanch of Venoothanapalle Panchayat, Pothapatlu Mandal, Chittoor district pursuant to the election of the petitioner as Sarpanch in the year 1995.
Heard the learned counsel on both sides.
Inasmuch as it is stated that the term of the petitioner as elected Sarpanch of Venoothanapalle Panchayat, Pothapatlu Mandal, Chittoor district is stated to be coming to an end and in view of the representation of the learned counsel that cause in the writ petition does not survive for consideration, the writ petition is dismissed as infructuous. No costs.
