ORDER:
The Writ Petition is filed for issuance of an appropriate writ, order or direction more in the nature of writ of mandamus seeking to auction Chinnadhandluru sand quarry reach, Yerraguntla Mandal, Kadapa District without confirming the tender in petitioner’s favour as the petitioner is the only subsequent highest bidder pursuant to the tender notice in Ref.No.131/2005/A4, dated 9-8-2006, as arbitrary, unjust, illegal, contrary to Rule 9 H(4) of the Minor Minerals Concession Rules and violative of the fundamental rights guaranteed under the Constitution of India and to issue a consequential direction to the respondents to confirm the tender in favour of the petitioner pursuant to the tender notice dated 9-8-2006 and to pass such other suitable orders.
It is stated by the learned Assistant Government Pleader that the auction was conducted on 4-10-2006. The same is hereby recorded.
In view of the same, liberty is given to the writ petitioner to question the same if the writ petitioner is so advised. Accordingly the Writ Petition is closed. No costs.
