ORDER:
The petitioner is statedly the owner of land admeasuring 453 square yards in Survey No.252/2 situated at Kushaiguda Village of Kapra Municipality in Ranga Reddy District. He filed the present Writ Petition apprehending that the respondent might interfere with his possession on the strength of the Government Order, being G.O.Ms.No.367, dated 12.07.1988. By the said Government Order, the Government of Andhra Pradesh so as to ensure planned growth of metropolitan region of twin cities issued certain guidelines duly directing the Commissioners of Municipalities and the respondent to take necessary action keeping in view the guidelines. The petitioner alleges that though the Government Order has no retrospective effect, he was given to understand that the authorities of the respondent might remove the existing structures. Therefore, the present Writ Petition is filed.
The case was filed in 1995 and it is coming up for final hearing from December 2004 onwards. Today when the case is called, none appears for the petitioner and the learned Counsel for the petitioner is absent. Learned Standing Counsel for Hyderabad
Urban Development Authority, however, submits that the Writ Petition is filed on a mere apprehension and the Officials of the respondent never made any attempts to demolish the structures in Kapra Municipality.
The Writ Petition is filed on a mere apprehension and is accordingly dismissed. No costs.
