This writ petition is filed alleging that investigation is not expeditiously conducted and charge sheet filed in Crime No.52 of 2006 on the file of the second respondent.
Counter-affidavit has been filed stating that the final report has been filed recording that the complaint is a mistake of fact.
In these circumstances, the petitioner seeks to withdraw the writ petition with a liberty to pursue appropriate remedies against the final report.
Accordingly, the writ petition is dismissed as withdrawn with liberty to the petitioner to pursue appropriate remedies. There shall be no order as to costs.
