The petitioner, a junior lecturer working in one of the Andhra Pradesh Residential Junior Colleges being run by the respondentSociety, has filed this Writ Petition seeking Writ of Mandamus to declare the action of the respondent in not considering his representation dated 5-5-2006 as illegal and for consequential direction to consider his request for appointment to the post of Principal in the Andhra Pradesh Residential Junior College, at Nagaram in Nizamabad District.

The petitioner was working as Urdu Junior lecturer in Andhra Pradesh Residential Junior College, at Nagaram in Nizamabad District. When he was working as such, he made a representation dated 5-5-2006 to the respondent-society for his appointment as

Principal of the said college on the ground that he is the senior most lecturer.

On instructions, it is submitted by the learned Standing Counsel appearing for the respondent that in the counselling conducted for general transfers, the petitioner had opted his choice to Kurnool and accordingly he was transferred to Kurnool and he is working in A.P. Residential Junior College, Kurnool.

As much as, now, the petitioner is not working in Andhra Pradesh Residential Junior College, at Nagaram, Nizamabad District, no direction can be issued to consider his representation dated 5-52006. It is submitted by the learned Standing Counsel that with regard to fixation of seniority among the junior lecturers, there were some complaints and a committee is constituted to rectify the defects if any in fixation of the seniority and the respondent-society is awaiting the report of the said committee. It is further submitted that pending receipt of the report from the said committee, the respondent-society is appointing the principals only on full additional charge basis. In that view of the matter, I do not find any merit in this Writ Petition for grant of direction as prayed for. However, after fixation of the seniority, it is open for the petitioner to make fresh representation for his appointment as Principal and it is equally open for the respondent to consider the representation of the petitioner.

Subject to the above direction, the Writ Petition is disposed of. No order as to costs.
