The petitioner, who appeared for Engineering And Medical Common Entrance Test-2006 and secured the rank of 714, has filed this Writ Petition seeking Writ of Mandamus to direct the respondents to issue necessary application form to the petitioner for admission to MBBS/BDS course for the academic year 2006-2007 and to receive the same and consider his case in the counselling for admission to the said courses.

The petitioner secured the rank of 714 in EAMCET-2006. But, however, pursuant to the notification issued by the Registrar,

NTR University of Health Sciences, the petitioner did not make any application at all. In the affidavit filed in support of the Writ Petition, it is stated that the petitioner was suffering with Jaundice and fever and he also filed certificate to that effect given by the Doctor, from whom he has taken treatment.

As per schedule, counselling for Open Category was conducted on 14^th , 15^th and 16^th of July, 2006. In that view of the matter, question of issuing direction to the respondents to permit the petitioner for first phase of counselling for considering his case for admission at this stage will not arise. However, it is stated by the learned Standing Counsel appearing for the respondent-University, that to fill-up vacant and resultant seats in the open category, notification will be issued for second phase of counselling. As much as the petitioner has not at all applied pursuant to the notification issued by the respondent-University, I dispose of the Writ Petition directing the respondents to issue requisite application to the petitioner and receive the same and consider his case for admission in the second phase of counselling, as per the rank secured by him.

Subject to the above direction, the Writ Petition is disposed of. No order as to costs
