All the petitioners claim to be cultivating tenants of respondent Nos. 3 and 4 and also to be landless poor persons within the meaning of expression as defined in Section 82 of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 (for short ‘the Act’). They submitted applications for recognition as landless poor persons and for the benefits under Section 82 of the Act. These applications were rejected by the Assistant Commissioner of Endowments, Rajahmundry by proceedings dated 09-11-2005.

Aggrieved thereby in March, 2006, the petitioners preferred individual appeals before the Regional Joint Commissioner, Kakinada. The appeals are pending. Along with appeals, the petitioners preferred applications for grant of interim relief.

Aggrieved that neither the appeals nor the applications for interim relief were considered by the 1^st respondent, and while so, the respective temples have notified for public auction of the lease hold rights of the lands which are presently under the cultivation of the petitioners, the writ petition is filed.

In the circumstances and after hearing the learned counsel for the petitioners and the learned Government Pleader, the writ petition itself is disposed of directing the 1^st respondent to expeditiously and, in any event within a period of thirty (30) days from the date of receipt of a copy of this order, dispose of the substantive appeals preferred by the petitioners or alternatively the applications for grant of interim relief. Reasoned orders shall be passed by the 1^st respondent and communicated to the petitioners within the aforesaid time. It is also open to the 1^st respondent to consider applications moved by the petitioners for expeditious and urgent interim orders.

Nothing in this order shall be constructed as an

expression by this court on the merits of the petitioners’ claims either in the appeals or in the applications for grant of interim relief.

The writ petition is disposed of accordingly at the stage of admission. No costs.
