ORAL ORDER:
The writ petition is filed by the Muthawalli of Maszid-e-Badruddin, Durki village, Birkoor Mandal, Nizamabad District, complaining that despite the proceedings of the Chief Executive Officer, A.P. State Wakf Board dated 3.12.2005 appointing him as a Muthawalli and a letter written by the said officer to the Collector and District Magistrate, Nizamabad on 24.1.2006 directing the Collector to ensure that the lands of the Wakf in Sy.Nos. 376, 436, 437, 119, 371/1, 371/2 and 372 in an extent of Ac.14.17 guntas at Durki village, Birkoor Mandal be handed over to the Muthawalli for his management, the 3rd respondent has by the proceedings dated 6.6.2006 scheduled the lands for public auction for grant of leasehold rights and the auction is scheduled to be held on 13.6.2006.
The learned Government Pleader for Revenue, representing the 3rd respondent, has taken time for obtaining instructions on the last occasion and has today reported that the 3rd respondent has since dropped the proceedings and that no auction for the sale of the lands belonging to Masjid-e-Badruddin in the survey numbers aforementioned will be conducted by the 3rd respondent.
Recording the submission made on behalf of the 3rd respondent by the learned Government Pleader for Revenue and in the light of the said submissions, the writ petition is dismissed as infructuous. No order as to costs.
