Petition under Section 482 of Crl.P.C. praying that in the circumstances filed therein, the High Court may be pleased to quash the proceedings in C.C.No. 440 of 2003 on the file of the VI Addl. Chief Metropolitan Magistrate, City Criminal Court, Hyderabad against the petitioner herein.
The petition coming on for hearing upon perusing the petition and grounds filed in support thereof and order of High Court dt. 20-06-2006 made herein and upon hearing the arguments of Dr. P.B. Vijaya Kumar, Advocate for the petitioner and of and of the Public Prosecutor for the Respondent No.2, the Court made the following;
ORDER :-
“It is submitted by the learned counsel for the petitioner that the notice sent to R.1 is returned by Postal authorities without any endorsement.
The interim stay granted is extended for a period of four weeks.
The learned counsel for the petitioner shall take personal notice by RPAD to the counsel appeared for R-1 in lower court and shall file proof of service thereof into the Court within a period of four weeks from today, failing which the interim stay shall stand vacated.”
