All these writ petitions are filed by the petitioners, who are working as Telecomm Mechanics, seeking a declaration that they are entitled for placement in the pay scale of Rs.4000-6000 in the cadre of Telecomm Mechanics on completion of 16 years of service from the date of their first appointment as regular Mazdoor/GroupD/Telegrapher in terms of the judgment of the Central Administrative Tribunal, Hyderabad in O.A.No.1966 of 1999 dated 09.08.2000 and also the judgment of this Court in W.P.No.14744 of 2001 dated 16.10.2003 confirming the orders of the Central Administrative Tribunal.

According to the petitioners, they were originally appointed in the Telecomm Department, which later became part of BSNL, in the cadre of Group-D posts. However, according to the petitioners, there was re-categorisation and in that process, all the persons are entitled for placement in the pay scale of Rs.4000-6000 in the cadre of Telecomm Mechanics on completion of 16 years. As the benefit was not granted, some of the similarly placed persons approached the Central Administrative Tribunal vide O.A.No.1966 of 1999, which was allowed and the said order of the Tribunal was confirmed by this Court in the above referred writ petition. Therefore, the petitioners sought for similar treatment by placing them in the pay scale of Rs.4000-6000 which is applicable to Group-C employees of the respondent-Corporation.

The learned Standing Counsel appearing for the respondentCorporation though fairly conceded that the issue in question is covered by a decision of a Division Bench of this Court referred to earlier, contended that as the petitioners have come up with the present writ petitions after a long lapse of time, they are not entitled for the relief. In support of his contention, he relied upon a decision of this Court in Mohd.Ameeruddin and others v Osmania University, Hyderabad, wherein the petitioners therein, who were the non-

teaching staff of Osmania University, sought for certain benefits basing on the Supreme Court judgment. In the said case, as the petitioners had already retired from service voluntarily without any protest at the age of 58 years between 1985 to 1996 and having not filed any writ petition questioning the age of supperannuation, they cannot now seek the relief in the light of the judgment of the Supreme Court in the year 1997. In the light of said decision, according to the learned Standing Counsel, the petitioners are also not entitled to any relief at all as the relief is barred by limitation.

Heard both sides and considered the material on record.

In the case relied upon by the learned Standing Counsel, the petitioners retired long back without any protest and without approaching any Court of law. They approached the Court only when certain other persons got the benefit from the judgment of the Supreme Court and, therefore, their claim was negatived. In the present case, admittedly, the petitioners are in service. Therefore, it is not proper and just to deny the benefit of higher scale of pay, which was extended to other similarly situated persons, on account of delay or laches. The benefit may be confined by restricting prospectively, but the relief cannot be totally rejected as the right to claim the scale of pay on par with others is a recurring right accrued every month.

In view of the above decision, there is no justification to deny the benefit to the petitioners to be treated on par with others, who are similarly placed, for placing in the pay scale of Rs.4000-6000. However, the claim of the petitioners is restricted prospectively granting the benefit only from 01.01.2005. The petitioners are not entitled for any back wages prior to the said period as admittedly the petitioners approached this Court by filing the present writ petitions only on 28.12.2004.

Accordingly, the respondents are directed to place the petitioners in the pay scale of Rs.4000-6000 applicable to Group-C employees from the date of their entitlement notionally, but the monetary benefits are only from 01.01.2005.

The writ petitions are accordingly allowed to the extent indicated

above. No costs.
