ORAL ORDER:
This writ petition is filed seeking a Mandamus declaring the action of the respondents in not refunding the excess amount of Rs.23,63,100/- collected towards licence fees as illegal and arbitrary.
Heard the learned counsel for the petitioner and the learned Government Pleader for Prohibition and Excise and perused the
material placed on record.
An appropriate decision has to be taken by the 2nd respondent whether the petitioner paid the excess amount or not. The petitioner made a representation dated 21.3.2005 indicating the excess amount paid by him, but no action has been taken so far.
Therefore, without expressing any opinion on the merits of the case, I consider it appropriate to direct the 2nd respondent to take appropriate decision on the representation dated 21.3.2005 made by the petitioner in accordance with law within a period of two months from the date of receipt of a copy of this order.
The writ petition is disposed of in terms of the above direction. No order as to costs.
