Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to Issue any appropriate writ order or direction particularly one in the nature of writ of Mandamus declaring the action of the 2nd respondent in rejecting the petitioners case for rectification of pay scale anomaly on par with his junior Md.Ali Baig, vide Memo No. CE/O&M/KTPS/SAO/PRAIA/A2/D.No.1108/04, dt.30.4.2004 and the action of the 1st respondent in not considering the disposing of the petitioners Appeal dt.30.9.2004, as arbitrary, illegal and violative of Article 14, 16 and 21 of the Constitution of India and consequently direct the respondents to rectify the petitioners pay scale anomaly on par with this junior by granting S.P.P.-II scales from the date of passing of all the required tests (i.e. 2/96) and revise the petitioners pension, grant and pay the pensionary benefits accordingly and pass such other orders as may be just.

ORDER:
This writ petition is filed by the petitioner aggrieved by the inaction of the first respondent in disposing of the appeal/representation of the petitioner dated 30-09-2004.
2. According to the petitioner, he was appointed as LDC in the erstwhile APSEB on 11-02-1970. Later, the petitioner was promoted as UDC and also as a Junior Accounts Officer. However, the grievance of the petitioner is that there is an anomaly in the pay fixation of the petitioner, and therefore, he made a representation to the second respondent. The second respondent, however, rejected the same. Aggrieved by that, the petitioner made a representation/appeal to the first respondent on 30-09-2004, but the same was not disposed of till date. Hence, the petitioner has come up with the present writ petition.
3. Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents.
4. In the above circumstances, the first respondent is directed to dispose of the appeal/representation dated 30-09-2004 made by the petitioner with reference to the anomaly in the scales of pay as claimed by the petitioner expeditiously, preferably, within a period of eight weeks from the date of receipt of a copy of this order.
5. Accordingly, the writ petition is disposed of. No order as to costs.
