Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to call for the records from the respondents and issue an appropriate Writ, Order or Direction particularly one in the nature of Writ of Mandamus, declaring that the inaction of respondents in not considering case of the petitioner for appointment to the post of Junior Lineman or any other suitable post by not disposing of his representations of 2002 and 2003 as illegal, unjust, contrary to law, arbitrary, discriminatory, in violation of principles of natural justice and violative of Articles 14, 16 and 21 of the Constitution of India and consequently direct the respondents to consider the case of petitioner for appointment to the post of Junior Lineman, or any other suitable post along with the candidates who were interviewed on 13th and 14th October 2004.

The Court at the admission stage made the following ORDER:

The petitioner claims that he is working as a contract labour in the respondentcorporation. He claims that he acquired the requisite qualifications for the post of a junior Lineman, but he was not considered during the previous elections on the ground that 50% of the vacancies, reserved for contract labours are exhausted. The petitioner further contends that the respondent-corporation is presently selecting the candidates in the existing vacancies of junior Linemen, but he is not considered for the selection to the posts of junior Linemen. The petitioner, therefore, approached this Court seeking a direction to the respondents to consider his case for appointment to the post of junior Lineman or any other suitable post along with the other candidates.

In the light of the submissions made by the petitioner, the respondents are directed to examine whether the petitioner is a contract labour; whether he acquired the requisite qualifications suitable for the post of a junior Lineman and after verification of those particulars, to consider the case of the petitioner along with the other candidates regarding his request for appointment as a junior Lineman and pass appropriate orders according to the rules in force.

Accordingly, the Writ Petition is disposed of.
