Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court may be pleased to issue writ order or Direction more particularly one in the nature of Writ of Mandamus, declaring the inaction of the 1st respondent in not hearing the Appeal filed by the petitioner on 14-09-2004 before the first respondent against the order of the 2nd respondent in S.R. No. 5 of 2004 dt 27-07-2004 as arbitrary, illegal, unjust and is violative of Art, 14 and 21 of the Constitution of India and Consequently direct the respondent NO.1 to hear and dispose of the Appeal filed on dt 14-09-2004.

Against the ejectment order passed under A.P. Schedule Area Land Transfer Regulations in S.R.No.5 of 2004 by the second respondent on 27-07-2004, petitioner states that he filed an appeal on 14-09-2004 before the first respondent along with an application to stay the eviction, but the same has not yet been disposed of.

2. In view of the same, first respondent is directed to dispose of the application filed by the petitioner within a period of four weeks from the date of receipt of a copy of this order.

3. Till appropriate orders are passed on the said application, petitioner shall not be evicted pursuant to the order passed in the S.R.

The writ petition is accordingly disposed of. No costs.
