Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue a Writ, order or direction, more particularly one in the nature of Writ of Mandamus, to set a side the impugned transfer proceedings of 2nd respondent vide No. SB/813(4)/2004-VSO: VJA dt 27-7-2004 consequently to direct the respondents to continue the petitioner at present working place of Tenali APSRTC Depot and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.

The petitioner is working as a Security Guard in the respondent-Corporation at Tenali for the last four years and he is transferred to Macherla through the proceedings of the second respondent vide No.SB/813(4)/2004-VSO:VJA, dated 27.07.2004. Being aggrieved by the transfer order, he approached this Court through this writ petition, seeking writ of Mandamus to quash the order of transfer on the ground that he is a heart patient. The record produced by him is not prima facie indicating any heart ailment.

The respondent has every liberty to transfer its employees on administrative grounds to the required places and there is no illegality committed by the respondent. Therefore, the writ petition is not maintainable.

Accordingly, the writ petition is dismissed with a liberty to the petitioner to make a representation to the respondents with a request to reconsider the transfer. No order as to costs.
