Challenge to the Allahabad High Court's order dated 4.9.2006 in G.A. No. 58/2003 dismissing the State's appeal against acquittal under Sections 394, 307, 411 IPC for the armed snatching of Rs.1,25,000/- withdrawn from the State Bank of India on 15.3.1994, in which both victims were injured and part of the money was recovered. Acquittal upheld by the High Court solely on a telegram suggesting the arrest and recovery were doubtful. Relying on State of Rajasthan v. Sohan Lal (2004 (5) SCC 573) on the duty to record reasons, the Supreme Court held the High Court's conclusion presumptuous, noted the ignored victims' evidence and the bank-stamped recovered notes, set aside the impugned order, allowed the appeal and remitted the matter to the High Court.
