The contention that s. 4 of the Kerala Interpretation and General Clauses Act, 1125 was excluded by a different intention in s. 34(1) of the 1965 Act was rejected; under the proviso to s. 34(1) a proceeding enforceable under the repealed 1959 Act may be instituted under the corresponding provisions of the new Act, and s. 11(1) of the 1965 Act is no bar in view of s. 34(1); accordingly the appellant was liable to be evicted under the new Act even though the sub-letting preceded its commencement.
