The Commissioner of Income-Tax v. the Mysore Sugar Co., Ltd.
Case brief
What is this about?
Capital versus revenue expenditure; deduction under s. 10(2)(xv) and s. 10(1), Indian Income-tax Act 1922; bad debts s. 10(2)(xi); waiver of sugarcane grower advances ('oppige'/'oppigedar' agreements); 1948-49 drought; Mysore Sugar Co. Ltd.; referred question under s. 66A certificate; ITAT Madras Bench; precedents engaged: Badridas Daga v. CIT (1959) SCR 690 (referred); CIT v. Chitnavis (1932) LR 59 IA 290 (relied on); English Crown Spelter Co. v. Baker (1908) 5 TC 327, Charles Marsden & Sons v. CIR (1919) 12 TC 217, Reid's Brewery Co. v. Nale (1891) 3 TC 273 (all applied). Page also carries an unrelated closing fragment of a prior jute-mills appeals judgment (dismissed) and the opening headnote of Dr. C. Annachatriam v. Achlutha Menon (Marumakkattayam law, karnavan's power of delegation) — no holdings extracted from either fragment.
What did the court decide?
Section 10(2) does not deal exhaustively with the deductions which must be made to arrive at true profits and gains; cl. (xv) is a general clause, and the general scheme of s. 10 is that profits or gains are calculated after deducting outgoings reasonably attributable as business expenditure but not any part of capital expenditure.
