Rajnarain Singh, Secretary of the Rate Payers' Association, Patna, challenged the Governor of Bihar's notifications of 18 April 1951 (bringing Patna Village under the Patna Administration Committee) and 23 April 1951 (extending a modified s. 104 of the Bihar and Orissa Municipal Act, 1922, subjecting residents to municipal taxation) issued under ss. 3(1)(f), 5 and 6(b) of the Patna Administration Act, 1915 as amended by the 1928 Amendment Act, appealing from the Patna High Court's judgment of 22 December 1952 (Misc. Judicial Case No. 78 of 1952) which had upheld them. Held, applying In re The Delhi Laws Act, [1951] S.C.R. 747: delegated legislation may modify laws but cannot change legislative policy; s. 3(1)(f) is intra vires in the restricted sense (no essential change in, or alteration of the policy of, the Act); the 23 April 1951 notification is ultra vires for effecting a radical change of policy by imposing taxation without the hearing safeguards of ss. 4-6 of the 1922 Act; the 25 April 1931 notification and s. 5 are not open to challenge by this appellant.
